Free Web Design Terms and Conditions


Introduction

Welcome to Hanby IT Solutions (hereon referred to as Hanby IT). These Terms and Conditions (“Terms”) govern your use of our website design, development and hosting services. By applying for or using our services, you agree to be bound by these Terms. If you do not agree, you must not use our services.

Our Services

Hanby IT provides custom website design and development at no upfront cost to approved applicants, subject to these Terms. Although the website build is provided free of charge, the included free website scope is limited to a brochure website of up to five pages with one contact form integration. Our service includes:

  • Custom design and development of one brochure website of up to five pages
  • One contact form integration
  • Foundational SEO setup, including suitable page structure, technical SEO foundations, per-page metadata and relevant schema markup
  • Website hosting on Hanby IT’s infrastructure
  • SSL certificate
  • Security monitoring and maintenance
  • Ongoing technical support

Additional pages, advanced functionality, interactive features, third party integrations, bespoke tools, ecommerce, booking systems or other work outside this included scope are not included in the free website build.

Any additional work will be quoted and charged separately on a site-by-site basis. A quote will be provided for your approval before any chargeable additional work is carried out.

All services are provided subject to an active monthly hosting subscription following the expiry of the free trial period.

Application and approval

All applications are reviewed at our sole discretion. We reserve the right to decline any application without providing a reason. Acceptance of your application does not constitute a guarantee of any particular design outcome or timeline.

Hosting Subscription

A monthly hosting subscription is required to keep your website live and operational.

Hosting is currently charged at £20 per month for a standard website, or £40 per month for an ecommerce website, billed monthly in advance. Your subscription is on a 30-day rolling basis with no minimum contract term. You may cancel at any time by giving 30 days written notice to admin@hanbyit.co.uk.

Your monthly subscription includes:

  • Website hosting on Hanby IT’s infrastructure
  • SSL certificate
  • Security updates and monitoring
  • Ongoing SEO and AI visibility activities to help your business get found online
  • Access to an editor dashboard so you can make content changes and image changes within editable areas of your website
  • Ongoing maintenance and technical support

Website Hosting and Ownership

Please read this section carefully

Your website is designed, built and hosted entirely on Hanby IT’s infrastructure. The website code, design files, templates and technical environment remain the intellectual property of Hanby IT at all times. You are granted a licence to use and operate your website for as long as your hosting subscription remains active.

You may not:

  • Request transfer of website files, source code or design assets to another hosting provider
  • Attempt to replicate, copy or migrate your website to a third party platform
  • Sub-licence or resell access to your website

If you wish to move to a different website provider in the future, you would need to commission a new website independently. Hanby IT does not provide website exports, file transfers or code handovers under any circumstances.

Your website content, including text, images and other media that you have provided, remains your property at all times.

Post Launch Amendments

Any changes, updates or amendments requested from Hanby IT after your website has launched are not included within your monthly hosting subscription and will be quoted and charged separately.

This includes but is not limited to changes to design, layout, copy, imagery, page structure, functionality, interactive features, additional pages, additional integrations, bespoke tools, ecommerce or booking functionality.

All additional work is quoted on a site-by-site basis. Hanby IT will provide a quote for your approval before completing any chargeable additional work.

Hanby IT reserves the right to update your website’s technical infrastructure or hosting environment at any time to ensure continued performance and security. Such updates do not constitute a chargeable amendment.

Domain Names

You are responsible for the purchase, renewal and management of your domain name. Hanby IT will assist with the connecting of your domain to your website as part of the setup process.

Hanby IT is not responsible for domain expiry, loss of domain, or issues arising from your domain registrar. If your domain lapses or expires, your website may become inaccessible until the issue is resolved.

Cancellation

You may cancel your hosting subscription at any time by providing 30 days written notice to admin@hanbyit.co.uk. Upon cancellation:

  • Your website will remain live for the duration of your 30-day notice period
  • Your website will be taken offline at the end of the notice period
  • Website data and files may be permanently deleted 30 days after your website goes offline
  • No refunds will be issued for any unused portion of the current billing month

We reserve the right to suspend or terminate your service immediately in the event of non-payment, breach of these Terms, or misuse of our services.

Non-Refund Policy

All payments made after your free trial period has expired are non-refundable. This includes but is not limited to:

  • Payments for any unused portion of the month following cancellation
  • Payments made where cancellation notice was not given before the end of the trial period
  • Payments for months where the website was not actively used
  • Payments made following changes to your business circumstances

Your Responsibilities

You agree to:

  • Provide accurate, complete and lawful content for your website
  • Ensure that all images, text and other media you supply does not infringe any third party intellectual property rights
  • Review your website thoroughly and raise any concerns before the website goes “live”
  • Notify us promptly of any changes to your contact or billing details
  • Not use your website for any unlawful, harmful or fraudulent purpose

Limitation of Liability

To the fullest extent permitted by law:

  • Hanby IT is not liable for any indirect, incidental or consequential loss
  • This includes loss of revenue, profits, data or business opportunity
  • Our total liability to you is limited to the total hosting fees paid by you in the 12 months preceding any claim
  • We are not responsible for issues caused by third party providers, domain registrars or circumstances outside our reasonable control

Data Protection

We comply with UK GDPR and applicable data protection legislation.

Changes to these terms

We reserve the right to update these Terms at any time. We will provide reasonable notice of material changes. Continued use of our services following notification constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
